Terms of Service

1. Acceptance of Terms

By accessing or using the SeniorPop website located at seniorpop.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Services

SeniorPop provides educational information about Medicare benefits, including but not limited to OTC card benefits, grocery allowances, Part B premium reductions, Medicare Advantage plans, and Medigap coverage. We also offer interactive tools such as the Benefit Checker and Cost Estimator to help seniors understand their Medicare options.

SeniorPop is not a government agency, insurance company, or licensed insurance broker. We connect users with licensed Medicare advisors and insurance agents who can provide personalized guidance about Medicare plans available in their area.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Responsibilities

When using the Service, you agree to:

  • Provide accurate, current, and complete information when using our tools or requesting a callback
  • Not use the Service for any unlawful purpose or in violation of any applicable laws
  • Not attempt to interfere with or disrupt the Service or its servers
  • Not impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Not use automated systems (bots, scrapers, etc.) to access the Service without our written permission

5. Consent to Communications

By providing your phone number through the Benefit Checker or any form on this website, and by checking the consent checkbox, you expressly consent to receive:

  • Telephone calls, including those made using an automatic telephone dialing system (ATDS) or prerecorded/artificial voice messages
  • SMS/text messages related to your Medicare benefits inquiry
  • Telephone calls may come from SeniorPop and/or our network of licensed insurance agents and Medicare advisors
  • SMS/text messages are sent by SeniorPop only; SMS opt-in data and consent are not shared with any third parties

You understand that your consent is not a condition of purchasing any goods or services. You may revoke your consent at any time by replying STOP to any text message, calling us at (800) 555-0199, or emailing Jackie@seniorpop.com. Standard message and data rates may apply. We honor consent revocation received through any reasonable method, including but not limited to replying STOP, calling, or emailing us, in accordance with FCC regulations.

6. Third-Party Services

When you request to speak with a Medicare specialist, we may share your contact information and benefit preferences with licensed insurance agents and advisors in our network. These third parties operate independently from SeniorPop, and their use of your information is governed by their own privacy policies and terms of service.

Our Service may contain links to third-party websites or services that are not owned or controlled by SeniorPop. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

7. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of SeniorPop and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SeniorPop.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SeniorPop does not warrant that the information provided on the Service is accurate, complete, or current. The content on this website is provided for general informational purposes only and should not be construed as professional medical, legal, or insurance advice. Always consult with a licensed insurance agent or Medicare advisor before making decisions about your Medicare coverage.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SENIORPOP, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

10. Indemnification

You agree to defend, indemnify, and hold harmless SeniorPop and its licensors, employees, contractors, agents, officers, and directors from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of and access to the Service or your violation of any of these Terms.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If informal negotiation is unsuccessful, any unresolved dispute shall be submitted to binding arbitration in Las Vegas, Nevada, in accordance with the rules of the American Arbitration Association. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on this page. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
